On 1 January 2022, a simple prior declaration replaced the application for authorisation to be submitted by teaching researchers when they wish to carry out a secondary activity that falls within their statutory duties.
Decree no. 2021-1424 of 29 October 2021 specifies that “secondary activities corresponding to the missions mentioned in Article L. 123-3 of the Education Code and L. 411-1 of the Research Code are subject to a written declaration and are carried out for:
- a [public] higher education institution,
- a public research institution,
- a public institution governed by the decree mentioned in Article L. 112-6 of the Research Code,
- a public utility foundation whose main activity is public research,
- HCERES, a government authority, a local authority, an international intergovernmental organisation, an EU institution or body”.
For secondary activities not falling within this scope, such as, for example, work in private institutions, an application for authorisation to carry out secondary activities is still required.
The new written declaration must be submitted no less than 15 days before the start of the secondary activity to the hierarchical authority for which the main duties are carried out.
